PROMOTION DESCRIPTION: The Savvy Sweepstakes (the “Promotion”) begins on January 15, 2022 at 12:00:00 a.m. Eastern Time (“ET”) and ends on January 14, 2023, at 11:59:59 p.m. ET (the "Promotion Period"), subject to entry period dates and times as outlined in the “ENTRY PERIOD” section below.
ENTRY PERIODS: The Promotion shall include separate daily, monthly and quarterly entry periods. Daily entry periods will run from 12:00:00 a.m. ET to 11:59:59 p.m. ET each day of the Promotion (“Daily Entry Period”). Monthly entry periods will consist of a thirty or thirty-one day period during the Promotion Period beginning at 12:00:00 a.m. ET on the 1st of each month and ending at 11:59:59 p.m. ET on either the 30th or 31st of each month during the Promotion Period (each, a “Monthly Entry Period”) with the exception of the first Monthly Entry Period running from January 15, 2022 to January 31, 2022. Quarterly entry periods will consist of three (3) Monthly Entry Periods. Each entry period is its own promotion and entries from the previous entry period will NOT be eligible for subsequent entry periods.
Participation in the Promotion does not constitute participation in any other promotions, contests or sweepstakes. By participating in the Promotion, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Arroyo Media, 530 S Lake Ave. #250, Pasadena, CA 91101 (“Sponsor”), which shall be final and binding in all respects.
ELIGIBILITY: Promotion is open only to legal permanent United States residents residing in the fifty (50) United States and Washington D.C. who are at least eighteen (18) years of age and the age of majority in their jurisdiction of primary residence at the time of entry. Employees, officers and directors of Sponsor, its parent, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies (collectively, the “Promotion Entities”) and their immediate family members, and/or those living in the same household of each of the foregoing, are ineligible to participate in the Promotion. Promotion is void outside the fifty (50) United States, District of Columbia and wherever else prohibited by law.
HOW TO ENTER: To enter, go to savvysweepstakes.com (the "Website") and complete the sign-up form in its entirety, take the offer survey and submit. Once submitted you will receive an email confirmation, you must click on the link in the email confirmation to complete your entry. Your entry is not complete until you have clicked on the link in the email confirmation to verify your email address. During sign-up, you will have the opportunity to opt-in to receive telemarketing calls and/or text messages from Sponsor and its partners. Opting-in is optional and will not increase your chances of winning.
Limit one (1) entry per person, per email address, per day. In the event of a dispute over the identity of an entrant, entry will be deemed completed by the authorized account holder of the email address provided at the time of registration. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider, wireless carrier, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
Any and all entries that are submitted by the same entrant in excess of the applicable limits will be discarded. No individual may use more than one e-mail address to enter, and multiple individuals are not permitted to share the same email address. Any attempt by any individual to obtain more than the permitted number of entries by using multiple/different e-mail addresses, mobile devices, identities, registrations or any other method, will void all of that individual’s entries and that individual will be disqualified from participating in the Promotion. Sponsor reserves the right to reject any entries that it believes, in its sole and reasonable discretion, are fraudulent, incomplete or otherwise invalid. Sponsor is not responsible for entries, Promotion-related e-mails (including confirmation emails), claims or notices that are lost, late, illegible, misdirected, damaged, incomplete or incorrect. By registering for the Promotion, and where you have otherwise provided the requisite consent, you also agree to receive e-mail and direct mail marketing messages from Sponsor and its marketing partners, subject to Sponsor’s Privacy Policy available at savvysweepstakes.com/privacy-policy (the “Sponsor Privacy Policy”). You may opt-out of receiving these marketing messages at any time by following the instructions in the subject marketing message, or utilizing the options made available in the Sponsor Privacy Policy.
WINNING/ODDS: At the conclusion of each Daily, Monthly and Quarterly Entry Period during the Promotion Period, a representative of the Sponsor will randomly select the following winners: i) one (1) winner per Daily Entry Period, ii) two (2) winners per Monthly Entry Period and iii) two (2) winners per Quarterly Entry Period for each respective entry period. Each entry period is its own promotion and entries from the previous entry period will NOT be eligible for subsequent entry periods. Drawings will be conducted approximately two (2) business days following the end date of each respective entry period. Odds of winning will depend upon the total number of eligible entries received during the respective entry period. The Sponsor and the representative of the Sponsor decisions are based upon its sole discretion and interpretation of these Official Rules and are final and binding in all respects.
The Promotion Entities shall not be responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Promotion or by any technical or human error which may occur in the processing of the entries in the Promotion. The Promotion Entities assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration, of entries. NOTE: Entry must be by the entrant and only as directed in these Official Rules. Entry by any other individual or any entity, and/or originating at any website or other platform, including, but not limited to, commercial promotion subscription notification and/or entering service sites, will be declared invalid and disqualified for this Promotion. The use of any device to automate the entry process is prohibited and will lead to disqualification.
No more than the number of prizes set forth in these Official Rules will be awarded.
PRIZES:
Daily Prizes: One (1) prize of a $10 Amazon e-gift card will be awarded per Daily Entry Period (each a “Daily Prize”). A total of three hundred and sixty-five (365) Daily Prizes will be awarded. Total approximate retail value (“ARV”) of each Daily Prize is $10. Total ARV of each Daily Entry Period’s Prize to be awarded is $10.
Monthly Prizes: Two (2) prizes of a $250 gift card will be awarded per Monthly Entry Period (each a “Monthly Prize”). The gift card to be awarded will be determined by the Sponsor. A total of twenty-four (24) Monthly Prizes will be awarded. Total ARV of each Monthly Prize is $250. Total ARV of each Monthly Entry Period’s Prizes to be awarded is $500.
Quarterly Prizes: Two (2) prizes of either an Apple® iPhone 12 or a Samsung Galaxy will be awarded per Quarterly Entry Period (each a “Quarterly Prize”). The phone to be awarded will be determined by the Sponsor and the prize is only inclusive of the phone and not the cellular package through a mobile carrier. A total of eight (8) Quarterly Prizes will be awarded. Total ARV of each Quarterly Prize is $800. Total ARV of each Quarterly Entry Period’s Prizes to be awarded is $1,600.
Names of prize manufacturers are used solely for the purpose of identification of the prize. No endorsement, authorization, sponsorship, or approval by prize manufacturer for this Promotion is intended or implied.
PRIZE RESTRICTIONS: Daily Prizes shall be limited to five (5) per Entrant. Monthly and Quarterly Prizes are limited to one Monthly or one Quarterly per Entrant for the Promotion Period. Sponsor will determine all details of a prize in their sole discretion. Each amazon.com e-gift card or gift card Sponsor elects to award is subject to any terms and conditions, including but not limited to expiration dates, that may apply outlined by the gift card provider. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. No prize substitution, except at Sponsor’s sole discretion or as otherwise provided herein. Sponsor reserves the right to substitute a prize of equal or greater value if a prize becomes unavailable due to reasons beyond the control of the Sponsor; provided no such substitute prize shall be from Sponsor without its prior written consent. Prizes are not transferable prior to award.
DAILY PRIZE CLAIM: Daily Prizes will be sent via e-mail to the Daily Prize winner. In the event that a Daily Prize is returned as undeliverable that Daily prize winner will forfeit his/her right to the prize and an alternate Daily prize winner will be selected from the remaining eligible entries received for that respective Daily Entry Period.
MONTHLY PRIZE NOTIFICATION/CLAIM: Monthly prize winners will be notified by a representative of the Sponsor via email within three (3) business days from the end date of the Monthly Entry Period (the “Notification”). The Notification will request the mailing address information along with any other required info to confirm the entrant as a Monthly prize winner. In the event the Monthly prize winner does not respond by the date indicated in the Notification or does not provided the requested information, or if it is determined that a Monthly prize winner is not eligible in accordance with the Official Rules, he/she will be disqualified (without compensation of any kind) and alternate Monthly prize winner will be selected from the remaining eligible entries received for that respective Monthly Entry Period.
Monthly Prizes will be sent via USPS Priority Mail with Signature required. In the event that a Monthly Prize is returned as undeliverable, returned or unclaimed that Monthly prize winner will forfeit his/her right to the prize and an alternate Monthly prize winner will be selected from the remaining eligible entries received for that respective Monthly Entry Period.
QUARTERLY PRIZE NOTIFICATION/CLAIM: Quarterly prize winners will be notified by a representative of the Sponsor via email within three (3) business days from the end date of the Quarterly Entry Period (the “Notification”). Except where prohibited, Quarterly prize winner will be required to sign and return to the representative of the Sponsor, within the date and/or time indicated in the Notification an Affidavit of Eligibility and Release of Liability and Public Release Form and an IRS W-9 form (collectively the “Paperwork”) in order to claim the Quarterly Prize. If the Quarterly prize winner fails to return the Paperwork within that time frame, is found to be ineligible, does not comply with these Official Rules, or if the Notification is returned as undeliverable, then the Quarterly prize winner will be disqualified and an alternate Quarterly prize winner will be selected from among the remaining non-winning eligible entries received during the respective Quarterly Entry Period. All federal, state, and local or other tax liabilities (including income taxes) arising from the acceptance of the Quarterly Prize will be the sole responsibility of the Quarterly prize winner. The value associated with the Quarterly Prize is taxable as income and the Quarterly Prize Winner is solely responsible for any taxes, including, but not limited to all applicable federal, state, and local taxes that become due with respect to the value of the Quarterly prize. The Sponsor must report the value of the Quarterly prize to the Internal Revenue Service in the year the Quarterly Prize is received and will be reported to the Quarterly prize winner and the Internal Revenue Service in the form of a 1099 form.
PUBLICITY: Acceptance of a prize constitutes that prize winner’s permission for Sponsor and its designees to use the prize winner’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation.
RELEASE: Entrants agree that the Promotion Entities: (a) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Promotion or any Promotion-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize; and (b) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize including, without limitation, to such prize’s quality or fitness for a particular purpose. Sponsor assumes no responsibility for any damage to an entrant’s or any other person’s computer system or wireless phone which is occasioned by participating in the Promotion, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for: (i) lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; (ii) miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; (iii) any technical malfunctions, failures, difficulties or other errors of any kind or nature; or (iv) the incorrect or inaccurate capture of information, or the failure to capture any information.
DISQUALIFICATION: Sponsor reserves the right, in its sole discretion, to disqualify any individual who is found to be tampering with the entry process or the operation of the Promotion, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Promotion, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted.
GENERAL: Sponsor reserves the right to modify, extend, suspend, or terminate the Promotion if it determines, in its sole discretion, that the Promotion is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Promotion as contemplated herein. In the event Sponsor is prevented from awarding a prize or continuing with the Promotion as contemplated herein by any event beyond its control, Sponsor shall have the right to modify, suspend, or terminate the Promotion. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
INDEMNIFICATION: You agree to release, indemnify and hold the Promotion Entities harmless from and against any and all claims, expenses (including reasonable attorneys' fees, costs and settlement costs), damages, suits, costs, demands and/or judgments whatsoever, made by any third party due to or arising out of: (a) your improper and/or unauthorized participation in the Promotion; (b) your breach of these Official Rules; and/or (c) your violation of any rights of another individual and/or entity. The provisions of this paragraph are for the benefit of the Promotion Entities. Each of these individuals and entities shall have the right to assert and enforce these provisions directly against you on its own behalf.
GOVERNING LAW: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE PROMOTION SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF CALIFORNIA WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.
